Inexperienced Driver Criteria

Loss of or damage to cargo otherwise recoverable under this policy unless the insured is able to demonstrate to Underwriters from driver records (as defined below) that the driver who was in charge of the power unit at the time of the loss:

1. was aged between twenty-one (21) and seventy (70) years inclusive at the inception date of the policy or date of hire of the driver, whichever is the later; and
2. at the time of the loss holds a valid and in force driving licence for the power unit involved; and
3. adheres to either (a) or (b) below:

a. In the twenty-four (24) months preceding the inception date of this policy or twenty-four (24) months preceding the date of hire of the driver, whichever is the later, the driver who was in charge of the power unit at the time of the loss:

i. has continuously held a driver license issued in the United States or Canada which is valid for the power unit involved for the whole twenty-four (24) month period; and

ii. has no suspensions of any type on that license during the twenty-four (24) month period; and

iii. has, in connection with the use of any type of motor vehicle during the twenty-four (24) month period

• In the twenty-four (24) months preceding the inception date of this policy or twenty-four (24) months preceding the date of hire of the driver, whichever is the later, the driver who was in charge of the power unit at the time of the loss:
  • has continuously held a driver license issued in the United States or Canada which is valid for the power unit involved for the whole twenty-four (24) month period; and
  • has no suspensions of any type on that license during the twenty-four (24) month period; and
  • has, in connection with the use of any type of motor vehicle during the twenty-four (24) month period
    • no critical violations; and
    • no more than two (2) major violations;  and
    •  no more than three (3) minor violations.

or

• The driver who was in charge of the power unit at the time of the loss:
  • has continuously held a driver licence issued in the United States or Canada which is valid for the power unit involved for between twelve (12) and twenty-four (24) months prior to inception date of the policy or date of hire of the driver, whichever is the later; and
  • has no suspensions, or violations of any type in connection with the use of any type of motor vehicle since obtaining the driver licence for the truck involved.
